SERVICE
ANY FILINGS NEEDING SERVICE BY THE CIVIL SHERIFF MUST HAVE A COMPLETED SERVICE COVER SHEET ATTACHED AT THE TIME OF FILING OR PRESENTATION TO THE DIVISION.
COURTESY COPIES
Rule 9.9 of the Rules for Louisiana District Courts requires that a courtesy copy of motions, exceptions, memoranda in support, and oppositions thereto be delivered to the judges. Division F does not require that courtesy copies be delivered in paper format to chambers. All courtesy copies may be sent by email to Chale@orleanscdc.com.
RULE PROCEDURE
ZOOM HEARING: once you enter the zoom hearing, please ensure your microphone is on mute. Other matters could be set at the same time as your proceeding.
Live testimony requires a special setting Rule date. Special setting Rule dates are currently scheduled for Thursdays. Please schedule a special setting date through the Division. You must inform the court that your matter will require live testimony
Pursuant to Rule 9.9 of the Local District Court Rules, Memorandum in Support or in Opposition to Motions and/or Exceptions must be filed at least eight calendar days prior to the hearing date.
Continuances of Rules – in order for a rule to be continued, the party requesting the rule must submit written confirmation via fax or email to the Division that the opposing parties have been contacted and have no objection to the continuance.
JUDGMENTS
Judgments are to be submitted within 10 days of the hearing. The person preparing the judgment should present a copy to the opposing party at least 5 days prior to submission to the Judge and attach a Rule 9.5 certificate.
*NOTE: JUDGMENTS WILL BE DENIED IF THE 9.5 CERTIFICATE IS NOT ATTACHED.Consent Judgments are to be submitted within 14 days of the hearing. Signatures of representatives of the parties to the Consent Judgment shall be affixed to the Consent Judgment.
*NOTE: JUDGMENTS WILL NOT BE SIGNED IF THE JUDGE’S SIGNATURE LINE APPEARS ON A PAGE BY ITSELF.
All judgments may be submitted via email to Chale@orleanscdc.com, or have a hard copy delivered to chambers
TRIALS
All bench and jury trial dates require parties to schedule a Status Conference with the Division Minute Clerk
Trial dates will not be fixed until the parties certify that all discovery has been completed OR the parties have agreed to discovery deadlines within the Case Management Order.
The available times for a Status Conference with the Division Minute Clerk can be obtained by calling the Division or filing a request.
After the Status Conference has been conducted and a trial date selected, the parties are to jointly fill out the Discovery Cut-Off Schedule which can be found on the Division Webpage. Once the parties have filled out the Discovery Cut-Off Schedule, please email it back to the Division Minute Clerk at Nbutler@orleanscdc.com. Once the Minute Clerk has signed the Discovery Cut-Off Schedule, it will be fled with records
All parties shall receive a Notice of Trial and Trial Order within fifteen days of the Status Conference used to select a trial date. IF YOU HAVE NOT RECEIVED A TRIAL ORDER WITHIN FIFTEEN DAYS OF THE DATE OF YOUR STATUS CONFERENCE, PLEASE CONTACT DIVISION “F”
JURY DEPOSIT ORDERS
Once a trial date has been selected, the party who moved for the Jury Trial is responsible for filing the Jury Deposit Order to be signed by the Judge and sent to Bookkeeping
The Jury Deposit Order can be found on the Division Webpage under Forms.
THE JURY DEPOSIT ORDER IS DUE WITHIN THIRTY DAYS OF THE STATUS CONFERENCE DATE.
ASBESTOS CASES
To select a trial date for an Asbestos Proceeding, please contact Division Law Clerk, Chelsea Hale at Chale@orleanscdc.com
Asbestos Cases require a detailed Discovery Cut-Off Schedule which can be found on the Division Webpage
The Asbestos Cut-Off Schedule is to be emailed to the division Law Clerk once it has been filled out by the parties
Once the Division receives the Discovery Cut-Off Schedule, the parties will be sent a Status Conference Schedule with the Judge for updates through and until the trial date
